A booking photo is part of the arrest and booking file. In Costilla County, the official local custodian for jail booking and release records is the Costilla County Sheriff's Office. The research did not locate an official public Costilla County 24-hour release feed, 72-hour release feed, current roster, or booking-photo release page. That means a released person may have left the public view entirely, even though a releasable booking or release record may still be held by the agency.

Colorado treats criminal justice records under the Colorado Criminal Justice Records Act, not merely as ordinary administrative records. Official-action facts are generally more accessible, while other criminal justice records can involve custodian discretion, balancing, and redaction. Booking photos have their own special rule under C.R.S. 24-72-305.5. The statute prohibits obtaining a booking photograph knowing it will be placed in a publication or website that requires payment or another exchange for removal, and requesters must affirm that they will not use the photo in that pay-to-remove way.

Where Costilla Booking Photos Appear

The safest way to find a released Costilla County inmate's mugshot is to identify which system created the photo. A local jail booking photograph is different from a CDOC offender photo, a registry image, a news image, or a third-party mirror. The table below separates official and limited channels from non-authoritative ones.

Sheriff Roster and App Limits

Some counties publish booking photos on live jail rosters, daily booking reports, or recent-release apps. Costilla County is different. The official Sheriff's Office sources reviewed did not show a public inmate-search module, current jail roster, recent-release tab, 24-hour or 72-hour release list, booking-photo feed, or jail-info mobile app. The Sheriff's Office page instead provides records-request routing and sex-offender registry information.

For a recently released person, that absence is important. If a person no longer appears in a live jail view in another county, the disappearance may suggest release or transfer. In Costilla County, there is no official public online roster for that comparison. The practical route is to call the Sheriff's Office for immediate custody-status routing, submit a written records request for the booking/release record and booking photo if needed, and check the Costilla docket for the court event that caused release.

County pages use both Gasper and Gaspar spellings for the street address; call ahead if the street spelling matters for an in-person visit or mailing route.

Requesting a Booking Photo

A booking-photo request should be narrow, written, and tied to a specific person. Costilla County's open-records policy says requests must include the requestor's name, organization if any, mailing or email address, and be clearly identified as a Colorado Open Records Request or CORA request. The policy also says specificity helps the custodian locate records and may reduce fees. For criminal justice records, Colorado Attorney General guidance explains that CORA requests are treated under the CCJRA framework.

1. Identify the person with full name, date of birth if known, approximate booking or release date, and case number if known.
2. Ask for the releasable booking and release record, including booking date/time, release date/time, release reason/type, charges or case number, bond information if applicable, transfer agency if applicable, and any releasable booking photograph.
3. Send the request to the Costilla County Sheriff's Office records channel by email, mail, or in person as listed by the county.
4. Be prepared to sign the C.R.S. 24-72-305.5 statement confirming the photo will not be posted in a publication or on a website that requires payment or another exchange for removal.
5. If the booking photo is withheld, redacted, sealed, not located, or not a sheriff record, ask which custodian holds the record or whether a court order affects access.

CDOC, CBI, and SOTAR Photos

CDOC offender search may show a mugshot and physical descriptors for state prisoners, parolees, released state offenders, or discharged offenders. This is useful when a Costilla County defendant was sentenced to the Colorado Department of Corrections. It is not the same as the county jail booking photo. A county release record may show transfer to DOC, while CDOC then becomes the state source for prison status, parole, release/discharge dates, and the state offender photograph.

A registry photo can identify a qualifying registered offender, but the registry is not a general released-inmate mugshot list. A person may be released from jail and never be a registrant. A registrant may appear long after a release event. Use registry images only within that legal context.

SOTAR is the Costilla-linked public registry channel, but it remains a registry tool for qualifying records rather than a jail-release photo gallery.

Use either registry source only after confirming that the person and record type fit Colorado registry coverage.

Court Records Before Photo Use

Court records are usually not the source of the mugshot itself, but they are often the best way to understand whether the arrest led to a conviction, dismissal, sentence, probation, deferred judgment, sealing, warrant recall, or other outcome. The Costilla County docket can be filtered to the county and can show hearing dates, case numbers, hearing types, appearance type, location, and courtroom. The court record/document request form allows Costilla County selection and includes criminal document options such as complaint/information, disposition/sentence order, and Register of Action.

The ROA is especially useful because the Judicial Branch describes it as a brief explanation of the case including charges, sentences, and minute orders. If a mugshot appears somewhere but the case was dismissed, sealed, reduced, or resolved differently than the photo page implies, the court record is the better source for correction. The request form states that responses are usually provided within three business days unless extenuating circumstances apply and lists copy, certified-copy, name-search, off-site retrieval, and research/redaction fees.

Third-Party Sites and News Sources

Third-party mugshot, jail, or data-broker pages may mirror Costilla-related arrest information, but they are not official release records. They can be stale, incomplete, mismatched, or disconnected from the final court disposition. This page does not link to commercial mugshot galleries, pay-to-remove publishers, or data brokers because Colorado's booking-photo law is specifically concerned with pay-to-remove misuse and because those sources are not reliable custodians.

Local news and official public notices can include photos in notable cases. They are not systematic release lists. Costilla County's jail infrastructure has been covered regionally, and the Sheriff's Office Facebook page appears in search results for official notices, but neither source replaces a sheriff record, court disposition, CDOC record, VINE alert, registry record, or direct confirmation from the agency that holds the file.

Sealing, Removal, and Pay-to-Remove Law

Colorado's booking-photo statute does not mean every booking photo disappears from public records. It means a requester cannot obtain a booking photograph knowing it will be placed in a publication or on a website that requires payment or another exchange for removal, and it requires a statement from the requester. Colorado Freedom of Information Coalition guidance summarizes the same requirement and notes that frequent requesters may be allowed to submit the statement annually.

Sealing can change public access. CBI's court-order sealing information states that effective July 1, 2024, CBI no longer takes a sealing fee, although other court fees may still apply. The Judicial Branch record request form warns that suppressed cases, juvenile and probate records, and documents with protected information can require ID or be restricted. If a public photo appears after a case is sealed or the disposition has changed, use the official court order or corrected disposition when contacting the custodian or publisher.

For Costilla County, the clean workflow is to confirm the person and release through sheriff, court, or CDOC sources first; request a booking photo only when needed for identification or record accuracy; avoid reposting; and treat third-party photo pages as non-authoritative.
